  • Donda West’s Death Details

    The L.A. County Coroner’s office released this autopsy report today explaining that Donda West — Kanye West’s mother — “died from some preexisting coronary artery disease and multiple post-operative factors following surgery” and that “there was no evidence of a surgical or anesthetic misadventure.“  As you likely know, Donda passed away on November 10, 2007, following elective plastic surgery. 

    Although approximately 98,000 Americans “medical mistakes” each year, the coroner’s report doesn’t seem to classify Donda’s death as one of them.  As a result, any medical malpractice claim arising from Donda’s death might be difficult to prove.  Of course, Popsquire has learned over the years that there often are many sides to a story and infinite undiscovered facts, so stay tuned.   

    For any of you wondering…

    Medical malpractice is a form of negligence involving a medical treatment provider.  If someone is injured as a result of a treatment provider’s digression from the standard of care, that treater may be liable for the injury that has occurred.  The determination of whether a medical professional has met the standard of care is based on a comparison to other professionals in the same field and the same geographical region.

    In other words, what would a reasonably competent medical professional practicing in the same field as the defendant, and in the same area of the defendant, do under the circumstances that the defendant was facing with respect to care and treatment of the patient?
