Popsquire’s entertainment reporter / legal expert was on HLN’s “Prime News” yesterday just before Erin Andrews’ stalker was sentenced to 30 months in jail. I predicted 27 months. Give a lawyer a break, people!
Jennifer Garner’s alleged stalker, Steven Burky, is being held on $150,000 bail after cops found him near young Violet’s Santa Monica nursery school yesterday.
[Bauer Griffin Online]
Yes, near a nursery school. This is beyond terrible. Given that Jennifer obtained a permanent restraining order against Burky last year, the judge can (and should) throw the book at this guy.
Celebrity stalkers must go away, especially when they come anywhere near kids.
Miley Cyrus’ alleged stalker won’t be making the climb out of jail any time soon.
[Bauer Griffin Online]
A Georgia judge ruled that the man accused of attempted stalking of Miley is a danger to her and refused to reduce his bond. This means that his bond remains at $50,000 as he faces misdemeanor charges of disorderly conduct, obstruction and criminal attempted stalking of the 16-year-old star.
This judge likely knows the bond is the only way this guy will stay in jail. Stalkers rarely do much jail time unless they are repeat offenders and/or they disobey restraining orders.
Sadly, Miley Cyrus is joining the long list of celebrities who have been victimized by stalkers.

On Tuesday, a Georgia man was arrested on suspicion of stalking the Hannah Montana star. On Wednesday, a Georgia court granted a restraining order against him, and today police are searching his home.
In most jurisdictions, stalking is only a misdemeanor, and stalkers often walk away with little or no jail time. Maybe the police will find evidence to charge this guy with additional crimes and keep him away from 16-year-old Miley.

The Popsquire Beat presents this week’s most entertaining collisions between pop culture and law.
1. Tyra Banks’ stalker gets schooled.
Brady Green was found guilty of stalking Tyra back in April. This week, a NYC judge sentenced him to one year of probation and ordered him to enroll in an anti-stalking course called Project SHARP (Stopping Harassment and Relationship Problems). First lesson: “How To Smile With Your Eyes…From A Distance.”
2. Customers serve Kentucky Fried Chicken with a class action lawsuit.
After Oprah Winfrey promoted KFC’s May giveaway — “2 pieces of grilled chicken, two individual sides and a biscuit” — the chain couldn’t keep up with customer traffic. So, KFC handed out vouchers for free food on the next visit, but that isn’t good enough for some litigious customers who want the company to pay them back for the cost of printing coupons and travel, among other things. Seriously.
3. And, for this week’s video collision between pop culture and law, Popsquire joins the likes of Ashlee Simpson and Pete Wentz by participating in a NOH8 photo shoot. Watch!
Have a good weekend. Remember, please don’t drink and drive!
An Australian judge just tacked on additional jail time for Diana DeGarmo’s stalker.
In 2007, 23-year-old Tanya Maree Quattrocchi was sentenced to 150 hours of community service for cyber-stalking and blackmailing DeGarmo back in 2006, but she continued hacking into DeGarmo’s MySpace account and ended up in an Australian jail early this year. Now, a judge has sentenced Quattrocchi to 26 months in prison.

Popsquire followers are aware that celebrity stalkers write freaky letters to Uma Thurman, show up at Tyra Banks’ office, and travel cross-country to kidnap Shawn Johnson, but this video of country singer Gary Allan’s alleged stalker takes the cake.
Allan’s alleged stalker has been charged with burglary, stalking and vandalism. She’s due back in court in July.

Brady Green, the man accused of stalking Tyra, has been convicted of stalking, harassment, criminal trespass and attempted aggravated harassment in NYC. Green’s sentencing is scheduled for June, and he faces up to 90 days in jail.
Of course, even if he serves jail time, he might return to stalking Tyra. Stalkers often are repeat offenders and rarely get the mental help they need.

Tyra’s alleged stalker, Brady Green, faces misdemeanor stalking, harassment and trespassing charges after cops arrested him in March. In addition to sending unwanted flowers and love letters, Green allegedly threatened to kill Tyra’s assistant for not giving out the ANTM host’s address.
Cops say he was carrying a duffel bag filled with magazines with Tyra’s face on the cover and a receipt for the flowers he sent at the time of his arrest. He faces 90 dails in jail, if convicted.

UPDATE: Tyra is done testifying. She said she hired security in response to Green’s conduct and is scared to be alone, even going as far as having security trail her while she jogs. Makes sense. Stalkers are scary, even for giant supermodels!
Miranda Tozier-Robbins, the woman arrested for trespassing on to Britney Spears’ property last week, says the back gate “just kinda pushed open.” Yeah, right.
She seems credible about not being a stalker, though. Unless she makes a credible threat with the intent to place Britney in reasonable fear for her safety, Tozier-Robbins’ behavior likely is not prosecutable under California’s anti-stalking statutes.
Celebrity stalking must be the new black, because Tyler Perry joins Shawn Johnson, Jennifer Love Hewitt, Celine Dion, and many others in the long list of celebs who are being victimized.

Even though Tyler Perry previously obtained a restraining order against Dawne Wilson, she still showed up outside his production studio last week in southwest Atlanta. Police arrested Wilson, and she is scheduled to make a court appearance on April 30 to face charges of aggravated stalking.

UPDATE: TMZ reports that Wilson sent an email to Perry in April 2008, saying “You need to check your heart condition because it is filled with murder….your love has been but costly and deadly….Murder I say is the verdict.” Yikes!
Shawn Johnson’s stalker must stay at least 100 yards away from her and her parents for the next three years.

Shawn’s parents appeared in LA Superior Court today and persuaded a judge to grant a permanent restraining order against Robert O’Ryan, the man who traveled across country and allegedly tried to break into the Dancing With The Stars set to be close to and to abduct Shawn last month.
O’Ryan currently is being held on $220,000 bail after pleading not guilty to one count of felony stalking and two misdemeanor counts of carrying a loaded firearm in a vehicle.

An Australian woman convicted of stalking and blackmailing American Idol runner up Diana DeGarmo in 2007 will not be home for Easter.

Initially, the woman was sentenced to community service, but she continued hacking into DeGarmo’s MySpace account and ended up in jail. Despite pleas from her lawyer and mother that she would be better off getting treatment outside of jail, a judge is keeping her locked up at least until an additional hearing set for May 11.
Like Popsquire always says, don’t make a judge mad. If you get a chance to evade jail, don’t break probation or community service rules. It’s a sure-fire way to end up in jail!
A 49-year-old man was arrested earlier this week on suspicion of stalking and other charges after allegedly trying to break into Jamie Foxx’s Philadelphia hotel room on three separate occasions.

Jamie joins a long list of celebrities — including Shawn Johnson, Jennifer Love Hewitt, and Uma Thurman – in the Stalkers Club. Unfortunately, stalkers often are punished with minimal jail time or restraining orders and rarely get sufficient mental health help to prevent future stalking incidents. Sadly for Jamie, this guy likely will be back.
Dancing With The Stars continues to waltz into the long arms of the law.

In addition to casting two ex-cons, DWTS is now dealing with a stalker situation. Gymnast-turned-dance-prodigy Shawn Johnson obtained a restraining order yesterday against 34-year-old Robert Michael O’Ryan.
According to court documents, he: (1) tried to break into the DWTS studio on Monday; (2) had “a loaded .45 handgun, a loaded shotgun, and materials classically used for kidnapping including duct tape, zip ties [and] a map to the victim” in his car; (3) believes that Shawn speaks to him personally through the tv and through ESP and that they will have a child together.
Yikes. This is even freakier than the stalkers who recently spooked Erykah Badu, Jennifer Love Hewitt, and Tom Cruise. Thankfully, O’Ryan is in police custody and being held on $35,000 bail!
UPDATE: Authorities charged O’Ryan with one felony count of stalking and two misdemeanor counts of carrying a loaded firearm in a vehicle.
