    In a 47-page brief, O.J. seeks an appeal of his armed robbery and kidnapping conviction based on alleged judicial misconduct, lack of racial diversity on the jury, and errors in sentencing and jury instructions.

    Prediction: The appellate court will let him rot.

    OJ Sentencing Coming Soon

    O.J. Simpson doesn’t want the whole nine yards…

    In anticipation of tomorrow’s sentencing, which could come as early as tomorrow, OJ’s lawyers are requesting minimum jail time for his felony robbery and kidnapping convictions.  He faces life in prison, officials are recommending 18 years, and OJ is asking for six.

    “Simpson has never previously been convicted of a crime,” the 61-year-old’s attorney, Gabriel Grasso, said in court papers. “Thus, he now stands before the court as a first-time offender.”  He’s right. It’s hard to swallow, but the lawyer is right.  Popsquire will keep you posted.

    Happy Anniversary, OJ…

    Because you are a faithful Popsquire follower, you already know that OJ Simpson was convicted of robbing two sports memorabilia dealers in Las Vegas on Friday.  A jury found Simpson guilty of armed robbery, kidnapping and 10 other counts, exactly 13 years after he was acquitted of killing his ex wife Nicole Brown and her friend Ronald Goldman.

    Like a good lawyer, Popsquire presents you with a timeline of events that led up to this conviction.  Enjoy!

    2007

    Aug. 21 – Memorabilia dealer Thomas Riccio tells FBI agents that Simpson wants to televise a confrontation with a collector he believes is peddling stolen Simpson memorabilia.

    Sept. 12 – Simpson checks into The Palms hotel-casino for a friend’s wedding, parties late at a casino nightclub.

    Sept. 13 – Simpson contacts former golf buddies, Clarence “C.J.” Stewart, of North Las Vegas, and Walter “Goldie” Alexander, of Mesa, Ariz., who also is in Las Vegas for the wedding. They discuss a plan to take sports memorabilia from dealers Alfred Beardsley and Bruce Fromong.

    About 7:30 p.m., police say, the three men and three others meet Riccio, rush into a hotel room at the Palace Station casino and seize items at gunpoint from Beardsley and Fromong. Beardsley and Fromong report an armed robbery. Simpson is questioned at the Palms hotel.

    Sept. 14 – Police name Simpson as target of investigation and question him again. Simpson tells The Associated Press no guns were involved and some of the items belonged to him.

    Sept. 15 – Police arrest Alexander at McCarran International Airport, question him and charge him with assault and armed robbery. He is released without bail. Simpson attends wedding of
    friend, Tom Scotto, at the Little White Wedding Chapel.

    Sept. 16 – Simpson is arrested at The Palms, questioned by police and booked into the Clark County jail on felony armed robbery, assault and conspiracy charges. A judge orders him held without bail. Police announce they are seeking several other men.

    Sept. 17 – Stewart surrenders to police, turns over items believed to be taken from Beardsley and Fromong, and is released on $78,000 bail. Fromong suffers heart attack, is hospitalized at Los Angeles hospital.

    Sept. 18 – Michael McClinton surrenders to police. District attorney formally charges Simpson, McClinton, Stewart and Alexander with nine felonies including kidnapping, which carries a possible life sentence. Simpson charged with additional felony count of coercion with a deadly weapon.

    Sept. 19 – Judge sets $125,000 bail for Simpson, who posts bond, is released from jail and returns home to Florida. Beardsley is arrested in Las Vegas on California parole violation. Charles Cashmore, of Las Vegas, surrenders.

    Sept. 20 – Beardsley appears in Las Vegas court, waives extradition to California, is ordered held without bail.

    Sept. 21 – Cashmore is arraigned and Charles Ehrlich, of Miami, turns himself in at court on felony charges. Judge sets bail for Ehrlich at $32,000 and $28,000 for Cashmore.

    Oct. 15 – Cashmore and Alexander cut plea deals in return for testimony against Simpson. Cashmore agrees to plead guilty to being an accessory to robbery, Alexander to conspiracy to commit robbery.

    Oct. 24 – New charges of felony coercion are filed against Simpson, Stewart, Ehrlich and McClinton, bringing the total number of charges to 12.

    Oct. 29 – McClinton agrees to plead guilty to robbery and conspiracy to commit robbery in return for testimony against Simpson. McClinton’s lawyer says his client will tell the court Simpson asked him to bring guns to the hotel room.

    Nov. 8 – Simpson appears in Las Vegas Justice Court for preliminary hearing.

    Nov. 14 – A justice of the peace rules that Simpson and two other men should stand trial on 12 charges, including kidnapping and robbery.

    Nov. 26 – Prosecutors file revised document in Clark County District Court dropping McClinton from the case and adding a list of 78 potential trial witnesses.

    Nov. 28 – Simpson, Stewart and Ehrlich plead not guilty to all 12 charges. District Court Judge Jackie Glass sets trial for April 7, 2008.

    2008

    Jan. 11 — Judge Jackie Glass signs order revoking Simpson’s bail. He flies from Miami back to Las Vegas.

    Jan. 16 — Glass reprimands Simpson and doubles his bail to $250,000 during custody hearing on allegations that Simpson violated terms of his release.

    Sept. 8 – O.J. Simpson trial begins with jury selection.

    The all-white jury in the O.J. Simpson Las Vegas trial for kidnapping and armed robbery heard opening statements yesterday from the prosecution and defense.  The debate centered around whether Simpson aimed to conduct an armed robbery or was on a mission to recover personal heirlooms that he claims were stolen from him.  If found guilty, Simpson could be sentenced to life in prison!

    O.J., 3.0!

    The greatest pop culture/law collision of all times is back!

    O.J. Simpson is set to stand trial starting September 15 in Las Vegas for armed robbery, kidnapping, and conspiracy, among other charges.  Jury selection was finalized yesterday, and the jurors will soon begin evaluating evidence related to an alleged sports memorabilia heist that O.J. is accused of masterminding a year ago.

    Did O.J. Do It?

    This is clearly the most outdated question anyone can ask, yet Mike Gilbert is releasing a book entitled “How I Helped O.J. Get Away With Murder.”  In the book, Gilber claims, among other things, that O.J. admitted killing Nicole Simpson and Ron Goldman.  Click here for a lengthy tv interview with the author, if you still care.

    Goldmans Still Permitted To Squeeze OJ

    popsquirecuff.jpgUnless you lived under a rock or were not yet born in the 90’s, then you know O.J. Simpson was found civilly liable and ordered to pay more than $35 million to the Goldman family for Ron Goldman’s wrongful death.

    Popsquire update…

    1. OJ still owes approximately $40 million, which includes accumulated interest.
    2. OJ appealed the 2006 renewal of the judgment, claiming that his move to Florida stripped the Los Angeles of Superior Court of jurisdiction.
    3. The California Court of Appeal decided yesterday to deny OJ’s appeal, thereby leaving the judgment in tact.

    The attorney for Fred Goldman said it best: “A plane ticket to Miami is not a free pass for a wrongful death judgment.”

    Who Did It?

    As a lawyer, Popsquire has learned that there are always two sides to a story. The recent example of this involves O.J. Simpson, a man who represents one of the biggest pop culture/law collisions the world has ever seen. Here’s the deal…

    1. Yesterday, TMZ reported that O.J.’s gal pal, Christy Prody, “suffered bruises and head injuries on Monday — but it was because of a fall — and not at the hand of the Juice.”
    2. Today, the National Enquirer disputes TMZ’s conclusion, reporting:

    “Once Prody was examined it became clear that she had more injuries than could have been caused by the fall. She had numerous large bruises and abrasions on her face, arms, legs and buttocks. Police are still investigating, despite an erroneous report on the Web site TMZ.com yesterday saying that Prody’s injuries were caused by the fall. Sources very close to the situation tell The ENQUIRER that information is incorrect.”

    Popsquire’s perspective…

    Although Popsquire is inclined to rely on TMZ’s credibility, it’s hard to believe the “I fell” excuse. One can’t help but wonder whether there’s more to a story when O.J. is involved.

    OJ Opens The Show

    Popsquire obviously must encourage everyone to watch tonight’s premiere episode of MyNetworkTV’s show, “Jail.”

    Starring the most recognizable collision between pop culture and law — O.J. Simpson — this debut promises to be highly entertaining with statements from Simpson including, “I have always believed in the jury system.”

    Update: O.J. Bail Doubled!

    Popsquire remembers where he was when O.J. Simpson was acquitted of murder in 1995.  Do you?  It looks like 2008 may provide us with some O.J. memories as well…

    As an update to this recent post, Popsquire presents you with this video of a Las Vegas judge scolding O.J. for his “arrogance or ignorance — or both.”  And, she doubled his bail to $250,000!

    Popsquire’s pop quiz: When someone is arrested, do they have to shell out the entire bail amount to get out of jail?

    Nope.  Generally, a bail bond agent will ask for 10-15% of the full bail amount as security to obtain a defendant’s release.  The bail agent is, in effect, lending the defendant money for a fee.  If the defendant skips bail, however, the bail agent is responsible for the entire bail amount.

    O.J. and J.S. Sitting In A Tree

    Popsquire never thought he’d ask this question…What do O.J. Simpson and Jessica Sierra have in common?  Judges are telling both of them to SHUT UP.

    As Popsquire described in this recent post, a Florida Judge scolded Jessica Sierra for talking to the press, telling her: “You are not a celebrity.  You are a drug addict.” 

    Now, as described in this motion, O.J. was taken into police custody today for allegedly attempting to dissuade a co-defendant from testifying and cooperating with law enforcement. 

    If true, this means that O.J. may be in violation of his bail agreement, which specifically forbids him from having direct or indirect contact with any victims, witnesses or co-defendants involved in his Nevada criminal case. 

    The hearing on the O.J. motion is scheduled for January 18, 2008.  Popsquire will be peeping out the situation and keeping you informed.  Stay tuned!
