Lionsgate and The Weinstein Company are trying to Push each other around in court!

They filed dueling lawsuits this week against each other over Sundance Film Festival hit, Push: Based on the Novel by Sapphire, which includes performances by Mo’Nique, Sherri Shepherd and Mariah Carey. Lionsgate announced it purchased the rights to distribute the film for approximately $5 million and enlisted Tyler Perry and Oprah for promotion purposes.
TWC’s attorney claims the company had “reached a firm agreement for the rights” to the film with a sales agency. Nonetheless, the sales agency went behind TWC’s back to make a better deal with Lionsgate, and Lionsgate should have known better than to interfere with TWC’s deal.
Clearly, TWC did not enter a long-form legal agreement, but that doesn’t necessarily mean the company automatically loses this case. The primary question is whether TWC and the sales agency had reached an agreement on all material terms and whether it was in some kind of writing, even an email. If neither occurred, Popsquire predicts a loss for TWC.

Mariah is now set to perform at the show, which airs LIVE on ABC, November 23 from Los Angeles. Other performers include Coldplay, Leona Lewis, Kanye West, Jonas Brothers, Alicia Keys, Rihanna, Ne-Yo, New Kids on the Block, Pussycat Dolls, Taylor Swift, and Pink.
