    Janet Jackson…24/7 Flu?

    Janet Jackson was hospitalized yesterday.  She was supposed to perform in Montreal yesterday but canceled the show after she “got suddenly ill” during her sound check and had to be rushed to the hospital.

    Let’s hope Canadian employees are more respectful of privacy than UCLA employees!  Because you are a faithful Popsquire follower, you likely remember that UCLA fired at least 13 employees for snooping into Britney Spears’ private medical records.

    Above all, Popsquire hopes Janet doesn’t feel Nasty for too long…

    UPDATE, noon: It turns out that Janet was released from the hospital last night.

    Cancer, Who?!?

    Christina Applegate is 100% clean and clear of cancer!

    Choosing to have both of her breasts removed after being diagnosed with breast cancer earlier this month, Christina explained to Good Morning America today that she “didn’t want to go back to the doctors every four months…I just wanted to kind of get rid of this whole thing for me.”

    If you or a family member is diagnosed with cancer or any other serious medical condition, it’s important to know that various laws can offer job protection. For example, under the federal Family and Medical Leave Act, people suffering from a serious medical condition may be entitled to 12 weeks of unpaid leave from work. The leave can be taken all at once or intermittently.

    Christina Applegate Diagnosed With Cancer

    Sad news: Christina Applegate announced over the weekend that she recently was diagnosed with breast cancer, but (thankfully) it is not life threatening. Her rep says:

    “Christina Applegate was diagnosed with an early form of breast cancer. Benefiting from early detection through a doctor ordered MRI, the cancer is not life threatening…Christina is following the recommended treatment of her doctors and will have a full recovery. No further statement will be issued at this time.”

    Smokin’ Shia

    TMZ reports that Shia LaBeouf is a wanted man/boy. An outstanding arrest warrant seeks Shia for failing to appear for a court appearance, arising out of a February 17 misdemeanor charge for public smoking in violation of Burbank’s public smoking ban.

    1. Stop smoking!
    2. If you smoke, Popsquire hopes you do so in any of the following areas in Burbank: (a) any city park or facility; (b) within 20 feet from any building entrance; and (c) sidewalks and pedestrian areas in downtown Burbank.

    Update: Attorney Michael Norris appeared in court today and plead not guilty on Shia’s behalf. A pre-trial hearing is now set for April 24, and trial is on calendar for July 11. Don’t bother marking your calendars, though, because this case is ripe for a plea bargain.

    Dare To Defame: Patrick Swayze (2)

    Unfortunately, the Enquirer’s report that Patrick Swayze has cancer is true…sorta.  Although Swayze has confirmed that he was diagnosed with cancer, his physician released this statement, denying that he has only five weeks to live: “Patrick has a very limited amount of disease and he appears to be responding well to treatment.”

    Popsquire’s perspective…

    1. Because truth is always a defense to defamation, the Enquirer is off the hook in terms of reporting that Swayze has cancer.
    1. Although the statement about Swayze’s prognosis is in dispute, the Enquirer likely is in the clear on that one, too.  To constitute defamation, a statement must allege “facts,” whereas a phrase about how long someone has to live likely would be considered an “opinion,” thereby providing the defense.

    Dare To Defame: Patrick Swayze

    The National Enquirer is reporting that Patrick Swayze has five weeks to live, because he was “diagnosed in late January with pancreatic cancer that has spread to other organs.”

    Popsquire’s perspective…

    Popsquire is setting the clock on the lawsuit countdown. Realize, however, that defamation lawsuits brought by celebs can be difficult to win. Unlike regular folk, celebs generally have to meet a higher standard.

    Celebs have to prove that the alleged defamatory statement is false and was made with malicious intent, meaning that it was published with either knowledge of falsity or in reckless disregard for the truth.

    Popsquire hopes there is no truth to this report. If it is, then Popsquire dedicates this Gorillaz hit to Swayze…

    Mold Mayhem

    popsquirebook1.jpgAccording to Jossip, a so-called “operative” claims that several Page Six employees are refusing to show up to work due to the alleged existence of “hundreds of toxic black mold spores that have just recently been discovered growing behind a series of file cabinets.”

    Popsquire’s perspective…

    The law generally requires employers to inform employees of workplace hazards and provide them with the information they need to work safely. Specifically, the federal Occupational Safety and Health Administration, Hazard Communication Standard, requires that an employer develop a comprehensive program to inform employees of hazards they may encounter in the work place and also provide them with training in the use and handling of products containing hazardous chemicals.

    This reminds Popsquire of the alleged rat infestation affecting the ladies of The View. What’s next…will there be scorpions attacking the good folks at TMZ?!?
