    TMZ has uncovered the sealed Gosselin divorce papers, which state in part: “plaintiff and defendant have been unable to agree as to the equitable distribution” of their marital property.  So, now what?

    This kind of statement is common in any divorce, especially at the beginning stages.  It’s a bit more complicated, however, than typical Hollywood celebrity divorces because, unlike California, Pennsylvania is not a community property state.

    It’s an “equitable distribution” state, meaning that marital assets are not automatically split in half but are divided according to several factors, including, among others: (1) each spouse’s contribution; (2) the length of the marriage; (3) the source of each spouse’s income; and (4) who has custody of the children.

    Popsquire hopes the family can resolve this dispute easily and without affecting the kids too much.  Yikes!

    Possible Divorce: Jon & Kate Minus Marriage?

    Cue sarcasm.  Shocking news: Jon & Kate Gosselin may be divorcing.

    Now cue the divorce court battle, which may be more complicated than the typical Hollywood divorce.  Unlike California, Pennsylvania is not a community property state.

    It’s an “equitable distribution” state, meaning that marital assets are not automatically split in half but are divided according to several factors, including, among others: (1) each spouse’s contribution; (2) the length of the marriage; (3) the source of each spouse’s income; and (4) who has custody of the children.

    Let’s hope the kids escape this divorce without too much emotional scarring.  Perhaps having cameras follow them around isn’t the best idea right now…

    Sean Penn No Longer Getting Divorced?

    Just weeks after filing for legal separation from his wife, Sean Penn is withdrawing his motion.

    This isn’t the first time this couple has done this.  In 2007, they filed for divorce and then got back together within months.  It’s like they’re a real life Katy Perry song — They’re in.  Then, they’re out.  They’re up, then they’re down.  They’re hot, then they’re cold.

    So, why file for divorce if you’re not sure?  The answer could be money.  A spouse may not be entitled to marital income after the date of court filing for separation.

    Mel Gibson’s Girlfriend Is Pregnant With His Child

    Mel Gibson must be thankful that California is a no-fault divorce state.

    Robyn Gibson filed for divorce on April 13.  Now, TMZ confirms that Mel’s girlfriend, Oksana Grigorieva, is pregant with his child and in her second trimester.  This won’t affect how Mel and Robyn split up their estimated $900 million estate under California’s divorce laws, but maybe Mel should be worried about them Catholic laws…

    Pregnant Kelis Files For Divorce From Rapper Nas

    At least Kelly Rutherford isn’t the only pregnant celeb going through a divorce these days.

    Kelis, who is seven months pregnant, cited irreconcilable differences in court documents she filed in Los Angeles yesterday.  She is asking for spousal and child support, as well as joint custody of their unborn baby.

    Seeking joint custody is a sign of an amicable divorce.  If she wanted to be aggressive, she could have asked for sole physical and legal custody of their mini-milkshake.

    Sean Penn Files For Legal Separation From Wife

    For Sean and Robin Wright Penn, the second time isn’t the charm.

    The couple filed for divorce back in 2007, but quickly got back together and voluntarily dismissed the proceeding.  Sean has decided to try for divorce again by filing for legal separation.  Now, the question is how much money the divorce will Milk from Sean’s estate in attorneys’ fees, child support, and alimony.

    Mel Gibson’s wife of 28 years, Robyn Gibson, filed for divorce, citing “irreconcilable differences.”  Without a pre-nup, community property rules in California may require the couple to split their estimated $900 million fortune.  Now, that’s Payback!

    The YouTube Divorcee Is Working On A Musical

    Tricia Walsh, best known for taking her divorce to YouTube instead of divorce court, has announced that she’s working on a musical.  Lucky for us, she’s providing a sneak peek at one of the autobiographical songs, Arm Candy, which features lyrics like: “Nothing but arm candy and a trophy wife.”

    Oh, Trisha, don’t be so hard on yourself.  You are much more than that.  You are a YouTube star!  That’s gotta count for something, right?

    Debbie Matenopoulos Divorce Heats Up

    Debbie Matenopoulos is asking for more than her Daily 10!

    In court documents related to her divorce proceedings, Debbie is asking for $12,558 in temporary monthly spousal support from her estranged music executive husband, Jay Faires, to help pay for their home.  She also claims that Jay isn’t being honest about his financial affairs in an attempt to decrease the amount of support he owes her.

    Good luck Debbie! Popsquire has been a fan since your days on The View.  Make sure you hire a forensic accountant to go through Jay’s financial records and locate all off-shore accounts, if any.  It can be difficult to prove that a spouse is hiding income, but Popsquire is rooting for you.

    OMFC…Oh My Family Court! (Cont’d)

    A Santa Monica judge just granted Kelly Rutherford’s request to visit her fellow upper east siders…

    After two days of courtroom testimony from Kelly and her estranged husband, Daniel Geirsch, the judge decided that it was in the best interests of the couple’s two-year-old son, Hermes, to travel with Kelly to NYC while she films Gossip Girl.  The judge commented that removing the child from his mother “cold turkey” could be detrimental to the boy and decided that both parents will have access to him.

    Specifically, Daniel — who says he will travel to NYC — is entitled to increased overnight visitation over the next few months as Kelly continues to shoot GG, and both parents are required to return to Los Angeles twice over the next two months, splitting custody during the two mandatory visits.

    Popsquire hopes they can reach a voluntary custody arrangement before their next court date, which is set for April.  Family law battles are gut-wrenching, but reaching an out-of-court compromise often simmers down the heat and minimizes drama.

    Then, maybe someone can take them both to court for naming their son after a handbag!

    OMFC…Oh My Family Court!

    Gossip Girl star Kelly Rutherford battled Daniel Giersch in a Santa Monica courtroom today over the custody of their two-year-old son, Hermes.

    Kelly and Daniel testified in this bitter dispute, which includes allegations of abuse and accusations of bad parenting from both sides.  The hearing is expected to resume tomorrow, and a ruling likely will follow shortly after.  Popsquire will keep you posted.

    Gossip Girl Divorce Gets Messy

    There is no xoxo between Kelly Rutherford and her soon-to-be ex, Daniel Giersch!

    In a heated divorce and custody battle, the Gossip Girl star is asking a LA Superior Court judge to prevent Giersch from leaving the country with their son because she fears they will disappear.  Meanwhile, Geirsch blames Rutherford’s bi-coastal, GG schedule for the downfall of their marriage and claims she has a violent temper, alleging that she has thrown a laptop at him and tried to hit him with her fist.

    Kelly should win this small part of the battle.  Typically, children are not permitted to leave the country without permission from both parents.  Of course, Popsquire will keep you posted!

    A Full Custody Battle

    Jodie Sweetin does not want to get her hair did!

    The former Full House star and her estranged hubby attended a mediation session yesterday as part of their ongoing custody battle.  The husband, Cody Herpin, revealed to Radar Online that he asked Jodie to take a hair follicle drug test, but she agreed only to a urine test instead.

    Nice try, Cody! Hair follicle tests can detect a longer history of drug use than urine tests, but California courts don’t really make people take hair follicle tests.  It doesn’t hurt to ask, though.  The couple is scheduled to appear in court on Feb. 9.  Popsquire will keep you posted.
