    Carrie Prejean Files Religious Discrimination Lawsuit

    Carrie Prejean claims to be “biblically correct,” but now the question is whether she is legally correct.

    After threatening to file a lawsuit last month, Prejean went for it today, alleging that she is the victim of religious discrimination, defamation, public disclosure of private facts, intentional infliction of emotional distress, and negligent infliction of emotional distress at the hands of Shanna Moakler, Keith Lewis, and the Miss California USA Organization.

    This must mean that the defendants were not willing to offer enough money to settle the case before it hit the court system.  Given the high profile nature of this case, the parties likely were too wed (pun intended) to their respective positions to enter any kind of compromise.

    LAPD: Jackson Case Not Just About Homicide

    Following today’s news from the LA Coroner’s office, the LAPD announced that it met with various federal agencies recently concerning the Michael Jackson investigation.

    The LAPD issued this statement:

    On August 20, 2009, the Los Angeles Police Department (LAPD) met with representatives from the United States Department of Justice, Drug Enforcement Administration (DEA) and the California Department of Justice, Bureau of Narcotics Enforcement (BNE) to discuss information discovered during the investigation into the death of Michael Jackson.  Based on that meeting and at the request of the LAPD, the DEA and BNE have initiated their own independent investigations into matters that the LAPD’s investigation uncovered that may not be directly related to the cause of death.

    The LAPD is the primary investigative agency responsible for the investigation into the death of Michael Jackson.  The Department will continue to use the assistance of the DEA and BNE as necessary, and these agencies will continue to cooperate with each other as their various investigations progress.

    The investigation into the death of Michael Jackson is ongoing and will result in the case being presented to the Los Angeles County District Attorney for filing consideration.  Until that time, LAPD detectives will continue to meet and confer with District Attorney representatives.


    Coroner Report: “Acute Propofol Intoxication” Is Cause Of Michael Jackson’s Death

    Two months after Michael Jackson’s death, this headline hardly comes as a surprise, but it’s official.

    The LA Coroner’s Office issued a press release today, stating that: (1) MJ’s death is a “homicide;” (2) the cause of death is “acute Propofol intoxication;” and (3) other conditions contributing to the death are the “Benzodiazepine effect.”

    This presumptively establishes causation for the manslaughter investigation.  Two big questions remain: (1) when will authorities arrest Dr. Murray?; and (2) can Dr. Murray find an expert witness to defend him by arguing it was OK to administer Propofol in MJ’s home?

    FYI, the toxicology report and the official Coroner’s report remain under seal.  There could be some additional gems both for the prosecution and the defense in those documents.

    Popsquire Beat: This Week In Pop Culture & Law

    The Popsquire Beat presents this week’s most entertaining collisions between pop culture and law.

    1.  Anne Heche isn’t happy with the child support settlement she entered last summer.

    The Hung star told David Letterman this week that her ex-husband, Coley Lafoon, is a “lazy ass” who sits around waiting for child support checks to arrive in the mail. Oh, Anne.  You missed one: Lafoon rhymes with “buffoon.”  Maybe next time.

    2.  Police are looking for the three people in this surveillance video who broke into Lindsay Lohan’s Hollywood Hills home.


    If you recognize them, please contact authorities.  Before doing that, though, please ask them if they found Lindsay’s film career while rummaging through her house.

    3.  And, Madonna preached to a Romanian audience about civil rights for gypsies, but it was a groove her fans couldn’t get into.

    Michael Jackson’s House: More Pills For Insomnia

    This is the week of search warrants in the Michael Jackson case.

    Following Monday’s revelation that Dr. Murray allegedly gave MJ “lethal levels” of Propofol, as described in a search warrant, details are emerging from the warrant used to search MJ’s house shortly after his death.

    According to this warrant, the first search of MJ’s bedroom a day after his death found marijuana, skin-bleaching and hair-growing ointments, anti-insomnia pills and empty bottles of several anti-anxiety drugs.

    No major surprises here.  It may show, however, that authorities have lots of work to do if they intend to investigate the prescribing habits of all of MJ’s doctors.
