Miss California Wants Her Dirty Pictures Taken Down
Carrie Prejean has lawyered up!
While she waits for Donald Trump to decide her fate as Miss California, Prejean’s lawyers have fired off a cease and desist letter to TheDirty.com. They demand that The Dirty take down topless photos of Prejean, because: (1) one of the photos allegedly was “taken under false pretenses when she was a 17-year-old minor and unable to consent to its creation;” (2) the website did not obtain Prejean’s or her parents’ consent; and (3) the photos caused Prejean emotional distress.
Predictably, The Dirty is standing on its First Amendment rights, refusing to take down the pictures and balking at any emotional distress claim. Of course, Prejean probably should be suing The Donald for emotional distress. He is dragging out the decision about her crown for what seems like for-ev-ah!
Prejean likely would lose both cases. The only question left is whether she will lose her crown.
